Performlist: This refers to the platform offered by Performlist where creators can create
and
sharePerformlists.
Performlist Platform: This is the online platform offered by
Performlist where creators can createand share Performlists, and where users have access to these
Performlists.
Third Parties: In this context, it refers to external parties or
organizations that are notdirectly involved with Performlist. These can include external advertisers,
service providers, or other companies.
Creator: A creator is a user of the Performlist platform who can create and make
Performlistsavailable to other users.
User: A user is someone who uses Performlists. In this context, it refers to a user who
accessesand uses Performlists on the platform.
Course: A Course is a collection of Performlists organized by the Creator around a specific
topic or skill set, which can be offered for sale, for free, or kept private for specific students within
the Performlist Platform.
Class: A Class is a session or group within a Course where students can enroll. Classes
allow Creators to manage and interact with students going through a Course.
Intellectual Property
As a creator on the Performlist platform, you are responsible for owning the intellectual property
rights of the content you upload. You may only upload content for which you have the rights or
obtained permission from the rightful owners.
The creator is solely responsible for the posted content and any legal consequences arising from it.
Performlist bears no responsibility for content posted by users and creators on the platform.
If you believe your intellectual property is being used without permission on our platform, please
contact us at info@performlist.com with necessary evidence. If the claim is valid, we will remove
the
infringing content and take appropriate actions against the offending creator, including removal
and/or banning from the platform.
You retain ownership of the content you post on our platform, including freely available
Performlists.
When you post content, comments, questions, reviews, you grant us the right to use, share,
distribute, and promote that content on any platform and in any medium, and to make adjustments or
edits as we deem necessary.
Submitting ideas and suggestions for new features or improvements to us does not entitle you to
compensation, royalties, or other rights.
Payouts en monitization
Creators are entitled to a revenue share of 60% of the Net Amount for each Performlist sale and 75%
for each class enrollment sold through the Performlist shop.
The Net Amount is calculated as the Gross Amount, minus any Transaction fees, Taxes, any mobile
platform fees applied to mobile provider checkout sales and any amounts paid to third parties in
connection with the Promotional Programs.
The Net Amount only includes revenue from the Performlists and Course classes created and sold by
the respective
creator. No revenue is shared from Performlists created and sold by other creators.
Revenues from Performlist and Course classes sales are paid out to creators on a monthly basis with
a minimum amount of
€100. There is a one-month cool-down period, meaning earnings from month 1 are available for payout
in month 3. For example, earnings from January will be available for payout on March 1.
In case of returns or refunds, earnings are deducted from the creator’s earnings. This means no
revenue is received for purchases that have been returned.
Payments are processed via Payoneer. Creators must have a valid Payoneer account to receive
payments.
Creators can submit payment requests through their platform accounts. Processing of requests may
take up to 7 business days. The status of payment requests is visible in the creator’s account. For
inquiries about payment statuses, creators can contact Performlist.
Performlist will provide an prove of payment to creators for their records, detailing revenues and
transactions.
We are authorized to use images, descriptions, and snippets of your Performlists and Courses for
promotional purposes across any medium. This includes advertising on other websites. The intent is
to promote your content; however, we will not share or distribute the full Performlists or Courses
without your consent.
A creator is responsible for determining a price for public Performlists and Courses.
It is possible that advertisements may be displayed in a Performlist when it is offered for free.
Income from these advertisements is used entirely for platform promotion and improvement. A creator
does not receive compensation from these advertisements.
If a list is offered for free, a creator does not receive compensation.
It is not possible to offer a Performlist that is attached to a Course individually in the shop.
Performlists that are part of a Course can only be accessed through enrollment in the Course.
Creators are allowed to keep their Course private and invite students from their own coaching setup
without using Performlist’s invoicing system.
It is possible to convert a free Performlist into a paid Performlist. The price paid by the user
(even if it is nothing in the case of a free Performlist) is the applicable price. It is not
possible to request compensation for the use of a Performlist afterward.
Using affiliate links in the description of Performlist items and Course content is allowed.
Tax Obligations
The creator is solely responsible for remitting any taxes and other legal obligations arising from
the income earned through Performlist. This includes, but is not limited to, income taxes, social
security contributions, and any other applicable taxes and levies. It is the responsibility of the
creator to comply with all relevant tax laws and regulations in their jurisdiction and to timely
file all required tax returns and payments. Performlist assumes no responsibility for creators’
compliance with tax obligations and will not provide tax advice. We advise creators to seek
independent legal and tax advice regarding their income from Performlist.
Insights and Statistics
Creators can find insights and sales statistics in their platform accounts, including revenue and
performance information for their Performlists.
Content Policy
Performlist stands for a safe and respectful environment for all our users. Posting hateful, racist,
violent, or otherwise illegal content on our platform is strictly prohibited. In cases of such
violations, we reserve the right to take immediate action, including making the content unavailable
or removing it.
When creators engage in such violations, they always receive a warning. Repeated violations may
result in permanent account removal.
While we reserve the right to delete or modify content in class communities upon request or when deemed necessary, we do not proactively monitor the content posted within these communities. The creator of the class is responsible for maintaining the community’s integrity and ensuring that the content aligns with our platform’s guidelines. Creators have the authority to delete posts and replies within their class communities if they find it reasonable to do so. However, creators are encouraged to manage their communities in a way that promotes a respectful and constructive environment.
Promotion and Marketing
At Performlist, we support our creators through promotion on external websites and platforms. We
understand the importance of increasing the visibility of your paid Performlists, and we provide
opportunities for promotion within our platform.
Creators have the freedom to promote their own content, including offering discounted prices for
their Performlists. External promotion on other websites and platforms is allowed and even
encouraged.
Feedback and Improvements
We greatly value feedback from our creators. Your insights help us continually improve Performlist.
You can provide feedback through the feedback links in the List Manager or directly via email at
info@performlist.com. We welcome suggestions, ideas, and comments that contribute to a better user
experience for all creators and users on our platform.
Disputes & Resolution
If a dispute arises, the involved party should report it as soon as possible. Creators and users can
file disputes related to transactions, content, or other related matters.
Performlist will investigate the dispute and attempt to mediate between the involved parties. We
will hear both sides of the story and aim for a fair and satisfactory resolution.
After investigation and mediation, Performlist will make a decision on the matter. This decision
will be based on Performlist’s terms and guidelines. We strive for fair decisions that consider the
interests of both parties.
If a resolution is reached, Performlist will take steps to execute the decision, such as refunds or
other relevant measures.
